Terms of Service
These Terms govern use of the LeadWise AI platform, portal, and website.
1. Acceptance
By accessing the LeadWise AI portal, using the LeadWise AI chatbot, submitting a contact form, or signing a Service Agreement, you agree to these Terms.
2. Who These Terms Apply To
Clients, Client Users, Agency Users, and Prospects.
3. The Service
LeadWise AI provides a lead qualification platform delivered over WhatsApp, Facebook Messenger, Instagram, TikTok, client websites, and paid ads. The platform runs on two data-driven engines: the Qualification Engine and the Scoring Engine.
4. Account and Access
Portal access uses Google Authentication. Users are responsible for the security of their Google account.
5. Acceptable Use
Users must not use the service for any Excluded Industry (alcohol, gambling, adult, cannabis), send unsolicited bulk messages, impersonate another person or business, reverse-engineer the platform, resell without a written agency agreement, or violate applicable law.
6. Client Obligations
Clients are responsible for their qualification questions and FAQs, for complying with data protection law, for their own Meta billing relationship, and for not configuring the chatbot to collect information they are not lawfully entitled to collect.
7. Intellectual Property
LeadWise AI owns all rights to the platform, the two engines, source code, and brand. Clients own their business data. Prospects retain rights to their own personal information.
8. Fees and Billing
Fees, billing cycles, and payment terms are set out in the Service Agreement.
9. Availability and Support
Availability targets and support commitments are set out in the Service Level Agreement.
10. Data Protection
Data handling is governed by the Privacy Policy and the Data Processing Agreement.
11. Termination
Clients may terminate per the Service Agreement. LeadWise AI may suspend or terminate access for breach of these Terms.
12. Disclaimers
LeadWise AI does not guarantee any specific number of leads, qualification rate, or business outcome. We are not responsible for Meta's, Google's, or TikTok's decisions regarding a client's account.
13. Limitation of Liability
To the maximum extent permitted by law, LeadWise AI's liability is limited as set out in the Service Agreement. We are not liable for indirect or consequential loss.
14. Changes to These Terms
We may update these Terms. Material changes are notified to Clients by email. Continued use after notice constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of South Africa.
